Our Draft Contract of Sale Process

What We Do

Selling property starts with a strong Contract of Sale

1

Draft

We order the searches, prepare the contract, and tailor the legal terms based on decades of practical property law experience.

Accurate contracts. Reduced risk. Smoother sales.

2

Review and Refine

We explain the contract, confirm key property details, discuss your requirements, and identify any issues that may affect your sale, such as unapproved works or existing tenants.

No generic contracts. No guesswork.

3

Finalise

We then finalise and issue you and the agent with a complete, market-ready Contract of Sale tailored to your property and your circumstances.

FAQs

Frequently Asked Questions

Everything you need to know about navigating your property sale with confidence.

How long does it take to prepare a draft contract of sale?

We can prepare the contract in a day, if needed. But it's best to allow longer in case the Council certificate takes longer or there are issues you need us to address.

Can I adjust settlement terms to suit my plans?

Yes. Your Contract of Sale can be tailored to suit your circumstances and future plans.

We can advise on and negotiate matters such as:

  • Settlement periods
  • Rent-back arrangements after settlement
  • Early release of the deposit
  • Existing tenancies and ending a tenancy
  • Special conditions to address your specific needs

The draft Contract of Sale is your offer to the market. A purchaser can either accept the contract as drafted or propose alternative terms for your consideration. We help you understand the options and negotiate terms that work for you.

A tailored contract can provide greater flexibility, reduce uncertainty, and help your sale proceed on your terms.

What must I legally disclose?

Certain documents and information must be disclosed by law when selling property. We make sure your Contract of Sale contains all required disclosures and prescribed documents, while helping protect your interests and minimise risk.

Compliant. Tailored. Ready for Exchange Sale Contracts.

What if I have unapproved works on my property?

Stop worrying. Talk to us! Every circumstance is different but we can advise you on what to do.

What if I’m selling an investment property and there are tenants in the property?

You can sell with the tenants. A copy of the residential tenancy agreement must be attached to the Contract. We can advise you on the tenancy and help you evaluate the pro’s and con’s of selling with or without a tenant.
